Case Summary

Meta (Facebook, WhatsApp, Instagram) is dominant in the market for personal social networks, which is across Europe, as well as the national markets for online display advertising on social media. Meta has acted unlawfully towards users of Facebook by processing personal data for advertising purposes without a valid legal ground.

Can I participate?

Eligible to join the claim are all persons domiciled in the Netherlands who have used Facebook since 1 april 2010.

Investigation

Numerous investigations are currently underway that address Meta’s use of personal data for advertising purposes. For example, on 19 December 2022, the European Commission sent a Statement of Objections to Meta over abusive practices benefiting Facebook Marketplace. It informed Meta of its preliminary view that the company breached EU antitrust rules by distorting competition in the markets for online classified ads. The Commission takes issue with Meta tying its online classified ads service, Facebook Marketplace, to its personal social network, Facebook. The Commission is also concerned that Meta is imposing unfair trading conditions on Facebook Marketplace’s competitors for its own benefit.

 

In March 2023, the Amsterdam district court held that Meta’s Ireland branch (which the court referred to as “Facebook Ireland” in its opinion) lacked legal grounds to collect and process data from Dutch users in order to serve them targeted advertisements.

Third-Party Litigation

On  3 November 2023, SOMI (Stichting Onderzoek Markt Informatie) started a collective action in the Netherlands against Meta. On 1 March 2024, DPS (Data Privacy Stichting) also initiated proceedings. Both foundations act on behalf of users  adversely affected by terms permitting Meta to process personal data for advertising purposes. 

 

SOMI claims immaterial damages of €500 per user and in addition material damages of €10 per user for each quarter that they had a Facebook account after 25 May 2018. DPS claims immaterial damages of €500-€750 per user as well as material damages (amount yet to be determined).
